TERMS AND CONDITIONS

Virginia Real Estate Pre-License Course

1. ENROLLMENT & REGISTRATION
1.1 Enrollment Acceptance

By registering for any course offered by BP School of Real Estate, you ("Student") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

1.2 Eligibility Requirements
  • Student must be at least 18 years of age
  • Student must possess a high school diploma or equivalent
  • Student must provide accurate contact and personal information
  • Student must not be subject to any Virginia DPOR license denial or revocation
1.3 Registration Confirmation
  • Enrollment is confirmed only upon receipt of full payment
  • Class spots are reserved on a first-come, first-served basis
  • BP School of Real Estate reserves the right to refuse enrollment to any applicant
1.4 Class Capacity
  • In-person classes are limited to a maximum of 10 students
  • Once capacity is reached, students may be placed on a waitlist for the next available class
  • BP School of Real Estate reserves the right to cancel a class due to insufficient enrollment (minimum 5 students) with full refund provided
1.5 Acknowledgment and Acceptance

By signing up and registering for the course, students acknowledge and accept all terms and conditions set forth in this document. Registration and payment constitutes agreement to these Terms and Conditions. No further signature is required at time of enrollment.

2. TUITION & PAYMENT
2.1 Payment Due
  • Payment is due in full at time of registration
  • Current course fees are published on the school website and registration materials
  • BP School of Real Estate reserves the right to modify course fees at any time
  • Fees are guaranteed only upon payment confirmation
2.2 Included Materials

Tuition includes:

  • All required textbooks and course materials
  • PSI exam preparation guide
  • Certificate of completion upon successful course completion
  • Access to instructor support during course duration
2.3 Payment Methods
  • Accepted: Credit card, debit card, ACH bank transfer
  • All payments are processed securely through our payment processor
2.4 Outstanding Balance
  • Students with outstanding balances will not receive their certificate of completion
  • Students with unpaid balances may be barred from future enrollment until account is current
3. REFUND POLICY
3.1 No Refunds
IMPORTANT: NO REFUNDS WILL BE PROVIDED UNDER ANY CIRCUMSTANCES WHATSOEVER.

Once payment is received, no refunds will be issued for any reason including but not limited to:

  • Student withdrawal before or after class start
  • Student dismissal for violation of school policies
  • Failure to attend classes
  • Failure to complete course requirements
  • Failure to achieve passing grade
  • Failure to pass PSI state examination
  • Change of mind or personal circumstances
  • Illness, emergency, or other personal matters
  • Work conflicts or scheduling issues
  • Dissatisfaction with course or instruction
  • School cancellation of class (transfer to next class offered instead)
3.2 Non-Transferable
  • Course fees are non-transferable to other individuals
  • Student may transfer to a different class date (one time only) if notified at least 7 days prior to class start
  • Transfer to different class date subject to $50 administrative fee
4. ATTENDANCE REQUIREMENTS
4.1 Mandatory 60-Hour Requirement
  • Virginia DPOR requires a minimum of 60 contact hours for pre-license education
  • Students MUST attend all 60 hours to receive certificate of completion
  • No exceptions can be made to the 60-hour requirement
4.2 Attendance Policy
  • Students must attend ALL scheduled class sessions in their entirety
  • Tardiness of more than 15 minutes may result in being marked absent for that session
  • Leaving class early (more than 15 minutes before scheduled end) may result in being marked absent
4.3 Missed Classes - No Makeup Sessions
CRITICAL: Missing any class session will result in removal from the current class. Students must re-enroll and start from the beginning in a future class.
  • Students who miss ANY class session will be automatically removed from the current class
  • There are NO makeup sessions available
  • Removed students must re-enroll in a future class from the beginning at full tuition price
  • No refunds will be provided for students removed due to attendance violations
  • This policy applies regardless of reason for absence (illness, emergency, family matter, work conflict, etc.)
4.4 No Excused Absences

BP School of Real Estate does not recognize "excused absences" due to DPOR 60-hour requirement. Regardless of reason (illness, emergency, family matter, work conflict), students must complete all 60 hours consecutively. Medical emergencies, family emergencies, or other circumstances do not exempt students from attendance requirements.

4.5 Attendance Verification
  • Attendance is tracked and verified through sign-in sheets
  • Students must sign in at the beginning of each class session
  • Failure to sign in may result in being marked absent
  • Fraudulent sign-in (signing for another student) will result in immediate dismissal
5. CLASS FORMAT CHANGES
5.1 Right to Change Format

BP School of Real Estate reserves the right to change class format from in-person to online delivery with proper notice to enrolled students.

5.2 Notice of Format Change
  • Students will be notified of format changes at least 7 days prior to the change
  • Notification will be sent via email and phone
  • Format changes may occur due to weather, emergency, public health concerns, instructor availability, or other circumstances
5.3 Student Obligations After Format Change
  • Students must continue course in new format (online or in-person as directed)
  • Students who cannot or will not attend in the new format will be removed from class
  • No refunds will be provided for format changes
  • Students may transfer to next available in-person class if space permits (subject to transfer fee)
5.4 Online Delivery Requirements

If class is moved to online format, students are responsible for:

  • Reliable internet connection
  • Computer, tablet, or smartphone with camera and microphone
  • Quiet environment for attending virtual classes
  • Technical troubleshooting on their own devices
6. ACADEMIC REQUIREMENTS
6.1 Passing Grade
  • Students must achieve a minimum overall grade of 70% to receive certificate of completion
  • Grading is based on quizzes, assignments, and final examination as determined by instructor
  • Students who do not achieve 70% will not receive certificate of completion
6.2 Participation
  • Students are expected to actively participate in class discussions and activities
  • Disruptive behavior, sleeping, excessive phone use, or lack of engagement may result in dismissal
6.3 Academic Integrity
  • Cheating, plagiarism, or any form of academic dishonesty will result in immediate dismissal without refund
  • Students dismissed for academic dishonesty may be reported to Virginia DPOR
7. NO GUARANTEE OF PASSING STATE EXAMINATION
7.1 Course Completion vs. License Obtainment
IMPORTANT: COMPLETION OF THIS COURSE DOES NOT GUARANTEE PASSING THE PSI STATE EXAMINATION OR OBTAINING A VIRGINIA REAL ESTATE LICENSE.
7.2 Student Responsibility
  • BP School of Real Estate provides education and preparation materials
  • Ultimate responsibility for passing the PSI exam rests solely with the student
  • BP School of Real Estate is not liable for student failure to pass the state examination
  • No refunds will be provided based on state exam results
7.3 PSI Examination
  • Students must independently register for and pay PSI examination fee (not included in tuition)
  • BP School of Real Estate is not affiliated with PSI and cannot influence exam results
  • Exam scheduling, fees, and requirements are set by PSI and Virginia DPOR
7.4 Additional Study
  • Students are encouraged to utilize additional study resources beyond course materials
  • BP School of Real Estate provides exam prep materials but does not guarantee they cover all exam content
  • Students should review Virginia DPOR requirements and PSI exam guidelines independently
8. CERTIFICATE OF COMPLETION
8.1 Certificate Issuance

Certificate of completion will be issued upon:

  • Completion of all 60 required contact hours
  • Achievement of minimum 70% overall grade
  • Completion of all required coursework and assignments
  • Account paid in full with no outstanding balance
8.2 Certificate Validity
  • Certificate is valid for application to Virginia DPOR for real estate license
  • Certificate does not expire but DPOR may have application timing requirements
  • Student is responsible for understanding and meeting all DPOR licensing requirements
8.3 Replacement Certificates
  • Lost or damaged certificates may be replaced for $25 fee
  • Requests must be made in writing to [email protected]
9. CODE OF CONDUCT
9.1 Professional Behavior

Students are expected to:

  • Treat instructors, staff, and fellow students with respect
  • Arrive on time and prepared for class
  • Minimize disruptions and distractions
  • Maintain professional language and demeanor
  • Follow all classroom rules and instructor directions
9.2 Prohibited Conduct

The following behaviors are strictly prohibited and may result in immediate dismissal:

  • Harassment, bullying, or discrimination of any kind
  • Use of alcohol or illegal substances
  • Threatening or violent behavior
  • Theft or destruction of property
  • Recording class sessions without prior written permission
  • Sharing course materials with non-enrolled individuals
9.3 Technology Use
  • Cell phones must be silenced during class
  • Laptop/tablet use is permitted for note-taking only
  • Social media use during class is prohibited
  • Recording (audio or video) is prohibited without express written consent
9.4 Dismissal for Conduct Violations
  • Students may be dismissed immediately for violation of Code of Conduct
  • No refund will be provided for students dismissed for conduct violations
  • Dismissed students may be barred from future enrollment
10. INTELLECTUAL PROPERTY
10.1 Course Materials Ownership
  • All course materials, handouts, presentations, and content are proprietary to BP School of Real Estate
  • Materials are provided for student's personal educational use only
  • Students may not reproduce, distribute, sell, or share course materials
10.2 Copyright Protection
  • Course materials are protected by copyright law
  • Unauthorized reproduction or distribution may result in legal action
  • Students who violate intellectual property rights will be dismissed without refund
11. LIMITATION OF LIABILITY
11.1 Educational Service Only

BP School of Real Estate provides educational services only. We do not:

  • Guarantee employment or income as a real estate agent
  • Guarantee acceptance by any real estate brokerage
  • Guarantee passing of PSI state examination
  • Guarantee obtaining a Virginia real estate license
  • Guarantee any specific career outcome
11.2 No Warranties

BP School of Real Estate makes no warranties, express or implied, regarding:

  • Fitness for a particular purpose
  • Merchantability of education provided
  • Accuracy or completeness of course content
  • Applicability to current real estate market conditions
11.3 Liability Cap

To the maximum extent permitted by law, BP School of Real Estate's total liability for any claim shall not exceed the amount of tuition paid by the student.

11.4 No Consequential Damages

BP School of Real Estate is not liable for any indirect, incidental, special, or consequential damages including but not limited to:

  • Lost income or business opportunities
  • Cost of retaking examination
  • Cost of alternative education
  • Emotional distress
12. PRIVACY & DATA PROTECTION
12.1 Student Information
  • BP School of Real Estate collects personal information necessary for course administration
  • Information collected: name, address, phone, email, date of birth, SSN (for DPOR reporting)
  • Information is stored securely and used only for educational and regulatory purposes
12.2 DPOR Reporting
  • BP School of Real Estate is required to report course completion to Virginia DPOR
  • Student information will be shared with DPOR as required by law
  • Students consent to this reporting by enrolling in course
12.3 Marketing Communications
  • Students may receive email communications about future courses or services
  • Students may opt out of marketing emails at any time
  • Opting out does not affect enrollment status or course-related communications
13. SCHEDULE CHANGES & CANCELLATIONS
13.1 School-Initiated Changes

BP School of Real Estate reserves the right to:

  • Change class dates, times, or location with 7 days notice
  • Substitute instructors as necessary
  • Modify course curriculum to maintain DPOR compliance
  • Cancel classes due to insufficient enrollment, emergency, or other circumstances
  • Change delivery format from in-person to online with proper notice
13.2 Class Cancellation by School

If BP School of Real Estate cancels a class:

  • Students will receive full refund of tuition paid
  • Students may transfer to next available class at no charge
  • BP School of Real Estate is not liable for any other costs or damages
13.3 Weather or Emergency Closures
  • In case of severe weather or emergency, class may be postponed or moved to online format
  • Students will be notified via email and phone
  • Postponed classes will be rescheduled; students must attend makeup session
14. VIRGINIA DPOR COMPLIANCE
14.1 Licensed School
  • BP School of Real Estate is licensed by Virginia Department of Professional and Occupational Regulation (DPOR)
  • Course curriculum is approved by DPOR
  • BP School of Real Estate maintains all required records and reporting as mandated by DPOR
14.2 Student Records
  • BP School of Real Estate will maintain student records for minimum 5 years as required by Virginia law
  • Records include: enrollment forms, attendance records, grades, completion certificates
  • Students may request copies of their records in writing

15. AMERICANS WITH DISABILITIES ACT (ADA)
15.1 Accommodations

BP School of Real Estate complies with the Americans with Disabilities Act (ADA) and will provide reasonable accommodations for students with documented disabilities.

15.2 Accommodation Requests
  • Students requiring accommodations must notify BP School of Real Estate at least 14 days prior to class start
  • Documentation of disability from qualified healthcare provider may be required
  • Accommodations will be determined on a case-by-case basis
  • Not all requested accommodations may be feasible given course requirements
15.3 60-Hour Requirement

The 60-hour DPOR requirement cannot be waived or modified for any reason, including disability accommodations.

16. DISPUTE RESOLUTION
16.1 Informal Resolution

Students with concerns or complaints should first contact BP School of Real Estate at [email protected] to seek informal resolution.

16.2 Mediation

If informal resolution is unsuccessful, parties agree to attempt mediation before pursuing legal action.

16.3 Governing Law

These Terms and Conditions are governed by the laws of the Commonwealth of Virginia.

16.4 Venue

Any legal action must be brought in Chesapeake, Virginia or the appropriate Virginia court.

16.5 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

17. MODIFICATIONS TO TERMS
17.1 Right to Modify

BP School of Real Estate reserves the right to modify these Terms and Conditions at any time.

17.2 Notice of Changes
  • Students will be notified of material changes via email
  • Continued enrollment after notification constitutes acceptance of modified terms
  • Changes apply to all enrolled students, including those in current classes
18. ENTIRE AGREEMENT
18.1 Complete Agreement

These Terms and Conditions constitute the entire agreement between BP School of Real Estate and Student regarding course enrollment.

18.2 Supersedes Prior Agreements

These Terms supersede all prior oral or written agreements, representations, or understandings.

18.3 No Oral Modifications

No oral modification of these Terms is valid. All modifications must be in writing and signed by BP School of Real Estate.

19. ACCEPTANCE OF TERMS
BY SIGNING UP AND REGISTERING FOR ANY COURSE OFFERED BY BP SCHOOL OF REAL ESTATE, STUDENT ACKNOWLEDGES AND ACCEPTS ALL TERMS AND CONDITIONS SET FORTH IN THIS DOCUMENT.

Registration and payment constitute full agreement and acceptance of these Terms and Conditions. Students agree that by completing the registration process and submitting payment, they have read, understood, and agree to be legally bound by all terms outlined in this document.

Students will be required to complete a separate Student Acknowledgment Form confirming their understanding of key policies.
